Terms of Service

These Terms of Service govern access to and use of TCG Gem. By accessing the website, creating an account, or using any feature, you agree to these Terms and the Privacy Policy. If you do not agree, do not use TCG Gem.

You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, you may use TCG Gem only with permission from a parent or legal guardian.

You must provide accurate account information, protect your password, and promptly report suspected unauthorized access. You are responsible for activity performed through your account unless prohibited by law. You may not impersonate another person or create an account for someone else without permission.

TCG Gem provides card and sealed-product catalogs, collection tools, price information, sales history, type guides, and related collector features. Features may be added, changed, suspended, or discontinued as the service develops. TCG Gem does not guarantee that every card, product, image, price, or sale will always be available or error-free.

Prices, historical sales, product details, and market estimates are provided for general informational and collection-management purposes. They may come from third-party sources, may be delayed or incomplete, and may differ from an actual purchase or sale price.

TCG Gem is not an appraisal service, broker, marketplace, investment adviser, or financial adviser. Nothing on the website is a promise of value or a recommendation to buy, sell, grade, insure, or invest in a card or sealed product. You are responsible for independently evaluating any transaction.

You may not:

• use TCG Gem for unlawful, fraudulent, or deceptive activity;
• interfere with the website, servers, security, or other users;
• attempt unauthorized access to accounts, systems, or nonpublic data;
• upload or transmit malware or harmful code;
• use automated systems to scrape, copy, or overload the service without written permission, except ordinary search-engine indexing;
• circumvent access controls, rate limits, or technical protections;
• misrepresent affiliation with TCG Gem; or
• use the service in a way that violates another person's rights.

TCG Gem's original interface, software, branding, written content, and data organization are protected by applicable intellectual-property laws. These Terms grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the service for lawful purposes.

Pokémon names, characters, card artwork, product images, symbols, and related trademarks belong to their respective owners, including The Pokémon Company, Nintendo, Creatures, and GAME FREAK where applicable. TCG Gem is an independent collector resource and is not endorsed by or affiliated with those rights holders.

TCG Gem may display information from or link to marketplaces, retailers, data providers, and other third parties. TCG Gem does not control and is not responsible for their content, availability, products, transactions, terms, or privacy practices. A link or reference does not necessarily mean TCG Gem endorses that third party.

TCG Gem may restrict, suspend, or terminate access when reasonably necessary to protect the service or its users, investigate suspected violations, comply with law, or enforce these Terms. You may stop using the service at any time and may request deletion of your account through the Contact page.

To the fullest extent permitted by law, TCG Gem is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. TCG Gem disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. TCG Gem does not warrant uninterrupted access, complete accuracy, or that the service will be free from harmful components. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

To the fullest extent permitted by law, TCG Gem and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or value, arising from use of or inability to use the service. TCG Gem is not responsible for losses from decisions based on pricing or market data. Where liability cannot be excluded, it will be limited to the greater of the amount you paid TCG Gem in the preceding 12 months or 100 U.S. dollars. Applicable law may provide rights that cannot be limited by these Terms.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless TCG Gem and its operator from claims, damages, losses, and reasonable costs arising from your unlawful use of the service, your violation of these Terms, or your violation of another person's rights.

TCG Gem may update these Terms as the service or legal requirements change. The effective date will be updated when changes are posted. Material changes may also be announced on the website or by email. Your continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.

If a provision of these Terms is found unenforceable, it will be modified only as much as necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without permission. TCG Gem may transfer these Terms as part of a reorganization, financing, merger, acquisition, or sale of the service. These Terms and the Privacy Policy are the complete agreement concerning your use of TCG Gem.
